Contract
Agreement
Contract language is German. The presentation of the products in the online-shop
does not constitute a legal binding offer rather a non-binding online catalogue.
After entering your personal data and by clicking the button “send
order” in the final step of the ordering process, you place a binding
order for products contained in the shopping cart. The confirmation for
the receipt of the order succeeds directly after sending the order. The
sales agreement materialises with our separate order confirmation via email
or fax or first with delivery of the goods. All prices are calculated including
sales tax. In general the following applies: The delivered goods remain
possession of www.abfalleimer.com until fully paid. Descriptive product
information such as illustrations, drawings, descriptions, data about measurements,
weight, performance and usage that can be found in brochures, on CD´s
or similar documentation are subject to confirmation as far as they have
not been explicitly designated to be binding. This is especially applicable
in the case of changes and improvements that serve technical advancement.
Slight aberration of such product descriptive information deems to be approved
and do not affect the fulfillment of contracts, as far as they are not unacceptable
for the buyer. |

Delivery

We deliver solely with DHL Express. Normally the packages are ready for
delivery in 2 - 3 days; the approximate delivery period adds up to 10 -
14 working days. ( Within the European Community ) and 20 -30 working days
( Worldwide ) Should a product once not be available for reasons that www.abfalleimer.com
cannot be held responsible for, particularly as a result of incorrect or
not properly executed pre-supply or in the case of demand exceeding stockage,
we reserve the right to deliver partially or not at all. |

Cancellation
Instructions
You can cancel your contract agreement within 2 weeks without stating the
reason in written form ( e.g. letter, fax, e-mail to info@abfalleimer.com)
or by returning the goods, unless you acted on behalf of your commercial
or freelance occupation (orders by businessmen). At the earliest the deadline
begins with receipt of the goods and detailed instructions in the written
form. The punctual dispatch of the cancellation or the goods is sufficient

Cancellation
Consequences
In the case of an effective cancellation the services actually rendered
on both sides are to be granted back and if necessary attained applications
(e.g. interest) returned. Should the services
actually rendered not be able to be granted back to us totally or partially
or only in a worse condition, a value replacement must be achieved as far
as that goes. Value replacement must not be achieved if the worsening of
the goods can be solely attributed to their examination as it would have
been possible for you in a store. Incidentally you as a customer can avoid
the duty of value replacement by not using the item as an owner and by avoiding
everything that can interfere with the value of the goods. Package-transportable
goods are to be sent back at our risk, non-package-transportable goods will
be picked up. You must fulfil obligations for reimbursement within 30 days
after dispatch of your cancellation. You
bear the costs for the return consignment if the delivered goods correspond
with the ordered ones and if the price of the returning goods does not
exceed 40 Euro or if, in the case of the price of the goods being higher,
you did not render your return service or a contractually agreed upon
partial payment at the time of cancellation. |

right of cancellation does not apply for
goods which are manufactured according to customer specifications or which
are clearly specific to personal requirements or which are not fit for a
return consignment as a result of their condition or which are quickly perishable
or whose expiration date has expired, * audio or video recordings or software,
as far as the delivered data carriers have been unsealed by you, * newspapers
and magazines. |

Payment
Payment can be made of your own choice either by prepayment, C.O.D. (cash
on delivery), Paypal or using credit card (American Express, Mastercard,
Visa); your account is charged at the end of the ordering process. For deliveries
within the Federal Republic of Germany. When purchasing pre-paid you receive
an order confirmation with your personal invoice stating our bank details.
In order to cover the credit risk we have to accordingly reserve the right
of the respective creditworthiness, effecting the delivery requested by
you only in the case of prepayment or C.O.D. Deliveries to the remaining
foreign countries can only be effected with prepayment, Paypal or credit
card. Further details can be obtained in the choices of the particular methods
of payment in the course of the ordering process.
